1. Agreement to Terms

By accessing or using VegasRebate.com (the "Service"), operated by LPT Realty LLC (the "Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, then you may not access the Service.

2. Description of Service

VegasRebate.com is a real estate rebate matching service that connects homebuyers with licensed real estate agents who offer cash rebates at closing. We provide:

• Rebate calculator tools to estimate potential rebate amounts
• Matching services with qualified real estate agents
• Information about rebate programs and real estate services
• Educational resources about home buying and rebates

We are a licensed Nevada Real Estate Broker (License #S. 23213) and operate in compliance with Nevada real estate laws and regulations.

3. Eligibility

To use our Service, you must:

• Be at least 18 years of age
• Be legally capable of entering into binding contracts
• Not be currently under contract with another real estate agent
• Provide accurate and truthful information
• Comply with all applicable laws and regulations

4. Rebate Program Terms

4.1 Rebate Amount

Estimates Only: The rebate amounts shown on this calculator are estimates based on a 0.5% commission rebate of the projected purchase price. Actual rebate amounts may vary based on:

• The final purchase price
• Commission offered by the seller
• Lender guidelines and approval
• Agent commission agreement
• Contract terms and conditions
• State and local regulations

4.2 Rebate Guarantee

We guarantee that participating agents have agreed to provide rebates as specified in your contract. However, rebates are subject to:

• Successful closing of the property
• Lender approval
• Compliance with all contract terms
• No breach of contract by the buyer

4.3 Agent Matching

We match you with qualified real estate agents who:

• Are licensed in Nevada
• Have a minimum 4.8+ star rating
• Are in the top 5% of agents in Las Vegas
• Have agreed to our rebate program terms
• Have passed background and performance verification

Agent availability is subject to market conditions and agent capacity. We cannot guarantee immediate agent availability.

5. User Responsibilities

You agree to:

• Provide accurate, current, and complete information
• Update your information as necessary
• Not use the Service for any illegal or unauthorized purpose
• Not interfere with or disrupt the Service
• Not attempt to gain unauthorized access to the Service
• Not use the Service to transmit any harmful code or malware
• Comply with all applicable laws and regulations

6. Existing Agent Contracts

If you are currently under contract with another real estate agent, you are not eligible for our rebate program until that contract expires or is terminated. We cannot and will not interfere with existing real estate contracts. If you indicate that you have an existing agent contract, you will be notified that you are not eligible at this time.

7.2 Lender Approval

All rebates are subject to approval by the Buyer's lender. Certain loan types (FHA, VA, Conventional) have limits on Interested Party Contributions (IPCs). If your loan program prevents the full rebate from being applied to closing costs, our Partner Agents will attempt to negotiate a price reduction, but the full value is not guaranteed if prohibited by law or lender restrictions.

It is your responsibility to consult with your lender about rebate terms and any potential impact on your loan.

7.3 No Guarantee of Results

We do not guarantee that you will:

• Find a suitable property
• Receive loan approval
• Close on a property
• Receive the exact rebate amount estimated

7.4 Licensed Representation

Fernando Polti is a licensed Real Estate Professional in the State of Nevada (Lic S. 203213) with LPT Realty LLC. This website acts as a lead generation and referral portal connecting buyers with licensed Partner Agents.

7.5 Not a Lending Offer

"VegasRebate.com" and Fernando Polti are not mortgage lenders and this is not a Loan Estimate.

7.6 Service Availability

We do not guarantee that the Service will be available at all times or that it will be free from errors, viruses, or other harmful components. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any errors or omissions in the Service
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code
• Any failure to close on a property or receive a rebate

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service or violation of these Terms.

10. Intellectual Property

The Service and its original content, features, and functionality are owned by the Company and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Clark County, Nevada.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The invalid or unenforceable provision will be replaced with a valid, enforceable provision that most closely matches the intent of the original provision.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the use of the Service and supersede all prior agreements and understandings.
